Initial Consultation Agreement
This Agreement, for the Virtual Immigration Consultation, is made between Regulated Canadian Immigration Consultant – Tetsoma Nikoro (R1041132), the ("RCIC"), and "the Client," for an immigration consultation (IC). It outlines the terms and conditions of the initial consultation meeting between the RCIC and prospective Client(s) (the "Client"):
1. Purpose: The purpose of the initial consultation is for the RCIC to:
- Determine your particular immigration situation based on the information you provide.
- Answer your questions related to Canadian Immigration laws and regulations to the best of our ability.
- Identify your options for Canadian immigration and, to the extent possible, analyze the costs and benefits of those alternatives.
- Provide you with the necessary information to assist you in what course of action you wish to take.
- Determine the next steps in the process, as mutually agreed upon.
2. Consultation Fee and Refund Policy:
The consultation fee of $120 CAD (plus applicable taxes) for a 60minute Immigration Consultation is required to be paid in advance and is strictly non-refundable. This includes, but is not limited to, situations where the client fails to attend the scheduled consultation (no-show), cancels the appointment, or changes their mind after payment has been processed. By proceeding with payment, you acknowledge and agree to this non-refundable fee policy.
Should the RCIC services be retained within 7 days from the date of the IC, an amount equivalent to the amount paid for the IC will be credited to the additional services
Retainer agreement required:
Following the initial consultation, if you choose to retain our services and we agree to provide services to you, we will prepare a separate, more detailed Retainer Agreement to be signed by both parties. This new Retainer Agreement will supersede this Initial Consultation Agreement and will outline the terms and conditions of our representation, including fees and specific services to be performed.
3. Limits of Engagement
• This agreement does not engage or oblige the RCIC to any further work or representation for the Client, and this agreement solely covers work as described above.
• The RCIC shall not provide further information or advice to the Client unless the Client and the RCIC have expressly agreed to a continuation concerning this and other matters, and the Client and the RCIC have entered into a separate written agreement concerning those other matters.
4. Other Conditions
The advice provided by the RCIC to the Client is based on Canadian immigration law. The RCIC is not responsible or accountable for any change in government legislation or policy that may impact the Client's processing of any subsequent application.
5. Confidentiality:
All information and documents provided to us during the initial consultation will remain strictly confidential. The RCIC is required to preserve the confidences and secrets of the Client, and this professional obligation exists to encourage candid and complete communications between the Client and the RCIC. All information and documentation provided by the Client and reviewed by the RCIC will not be divulged to any third party, other than the RCIC's agents and employees, without prior consent, except as demanded by law.
6. No Legal Authority Granted
The Client agrees and understands that this agreement does not constitute an engagement of the RCIC to act as your Authorized Representative in respect of any matters relating to Immigration, Refugees and Citizenship Canada, and/or the Canada Border Services Agency.
7. Acceptance
By paying the consultation fee, you agree to all the terms and conditions set forth above in this Initial Consultation Agreement. The laws shall govern this agreement in effect in the Province of Manitoba and the federal laws of Canada applicable therein.
Please be advised that Tetsoma Nikoro is a member in good standing of the College of Immigration and Citizenship Consultants (CICC), and as such, are bound by its By-laws, Code of Professional Ethics, and Regulations.
